HATZOPOULOS AND CO OE” with the distinctive title “KAKTOS PUBLICATIONS,” headquartered in Kallithea, Laskaridou 35, Postal Code 17676, legally represented, with VAT number 092311851, GEMI 955001000, Tax Office of Kallithea (hereinafter, “COMPANY,” “we,” “us”). The following Terms of Use and Conditions (hereinafter briefly referred to as “Terms of Use”) concern and govern the operation and use of the Online Store bearing the trademark “KAKTOS,” which operates at the electronic address www.kaktos.gr, and constitute a legally binding agreement between the visitors who voluntarily enter and transact or use the services of the website (hereinafter “users,” “customers,” “you,” “yourselves”) and the COMPANY. By accessing the Website, you agree that you have read, understood, and accepted all the Terms of Use.
IF YOU DO NOT AGREE TO ALL OF THESE TERMS, THEN YOU MUST REFRAIN FROM USING THE WEBSITE, YOU MUST TERMINATE YOUR VISIT AND REFRAIN FROM ANY TRANSACTION, INTERACTION, AND USE OF THE SERVICES OF THE E-SHOP.
1. GENERAL TERMS
1.1 The COMPANY engages in selling goods online (hereinafter “Services”) through the E-Shop, in compliance with the provisions of Law 2251/1994 (Consumer Protection), in conjunction with Presidential Decree 131/2003 (implementation of eCommerce Directive 2000/31/EC), the current national and EU legislation.
1.2 The COMPANY reserves the unilateral right to modify or update these terms and conditions of use and transactions of the online store, according to current needs and business practices. The COMPANY has the obligation to inform users of any changes through the Website of the Online Store, by updating the “Last updated” date of the Terms of Use.
1.3 Acceptance of the Terms of Use implies your waiver of any right to receive specific personal notification for any modification. It is your responsibility to periodically check these Terms of Use to stay informed of their revision. Continued use of the Website after the publication date of the revised Terms of Use implies acceptance of the changes in the Terms of Use on your part.
2. INFORMATION AND PRODUCTS OFFERED
2.1 The COMPANY commits to the accuracy, truthfulness, and completeness of the information provided on the online store, regarding the identity of the COMPANY as well as the information and Services provided through the Online Store. The COMPANY, in good faith, is not responsible for any technical or typographical errors and inaccuracies due to force majeure or electronic data entries made by mistake/omission during common experience, and reserves the right to correct them whenever it perceives their existence and at its sole discretion.
2.2 The COMPANY has the right to select, display, modify, withdraw, and resell products without prior notice. It also has the right to do the above with its discounts/offers, as well as with its pricing policy.
2.3 The information provided on the Website is not intended for distribution or use by any person or entity in any country where such distribution or use would be contrary to current legislation or would require the COMPANY to make any registration in accordance with the applicable law of that country. Therefore, those who choose to access the Website from other locations than Greece, do so at their own initiative and are solely responsible for compliance with the respective local legislation.
3. LIMITATION OF LIABILITY
3.1 The COMPANY, in the context of its transactions through the online store, shall not be liable to customers/users nor shall it be obliged to compensate them for damages that may arise from the execution or non-execution of their orders, for any reason, except in cases specified in clause 9 “Product Return.”
3.2 Furthermore, the COMPANY has no liability regarding the delivery time of goods in cases of force majeure, and provides no guarantee for the immediate availability of products. However, it informs interested customers based on the available data about the availability or non-availability of products and undertakes, in case of changes in this data, to timely inform users/customers about the unavailability of products, in which case it assumes no further liability. The Online Store provides content (e.g., information, names, photos, illustrations), products, and services available through the website “as they are.”
3.3 In no event shall the Online Store be liable for any legal, civil, and/or criminal claims (positive, special, or consequential, which indicatively and not restrictively, consist of loss of profits, data, missed profits, pecuniary compensation, etc.) by visitors of the website or third parties, due to a cause related to the operation or non-operation and/or use of the website and/or inability to provide services and/or information provided by it, and/or unauthorized interventions by third parties in products and/or services and/or information provided through it.
4. INTELLECTUAL PROPERTY RIGHTS
4.1 The entirety of the content of the Online Store, including images, graphics, photographs, designs, texts, animations, software, databases, music, audiovisual excerpts, advertising slogans, provided services and products, which fall under the protective provisions of Greek law, European law, and international conventions, constitute the intellectual property of the COMPANY, with the reservation of any Intellectual Property Rights of third parties protected by the relevant provisions of Greek, European, and international law on trademarks and industrial and intellectual property.
4.2 Any form of automatic or non-automatic copying, analog/digital recording and mechanical reproduction, distribution, transfer, downloading, modification, resale, creation of derivative works, or misleading the public about the actual provider of the website content, in whole or in part, is prohibited.
4.3 Any reproduction, republication, uploading, announcement, dissemination, or transmission, or any other use of the content, in whole or in part, by any means or medium for commercial or other purposes is only allowed with the prior written permission of the COMPANY or any other lawful holder of the above intellectual property rights.
4.4 The names, images, logos, and distinctive features representing the COMPANY and/or the online store and/or third parties affiliated with them, as well as their products and services, are exclusively trademarks and distinctive features of the COMPANY and/or the above third parties and are protected by the applicable national, European, and international legal framework on trademarks and industrial and intellectual property. In any case, their appearance and display on the website and in the online store do not imply in any way a transfer or assignment of a license or right to use them.
4.5 Specifically regarding the databases of the Website, the temporary or permanent reproduction of the databases in any medium or form, in whole or in part, translation, adaptation, arrangement, or any other transformation of the databases, any form of distribution of the databases or their copies to the public, any announcement, display, or presentation of the databases to the public, any reproduction, distribution, announcement, display, or presentation to the public of the results of translation, adaptation, arrangement, and transformation of the databases is prohibited. The databases of the Website are further protected (regardless of whether the said database or its content is protected by provisions for Intellectual Property or by other provisions) as a right of special nature of the database maker under the specific conditions and restrictions of the law (Article 45A, Law 2121/1993). The export and/or reuse of the whole or substantial part of the content of the databases, evaluated qualitatively or quantitatively, is prohibited. “Export” is considered as the permanent or temporary transfer of the whole or substantial part of the content of the databases to another material carrier by any means or in any form. “Reuse” refers to any form of provision to the public of the whole or substantial part of the content of the databases through distribution of copies, leasing, transmission by direct communication, or by other means. Repeated and systematic export and/or reuse of substantial parts of the content of the databases, involving actions conflicting with the normal exploitation of the databases or unjustifiably affecting the legitimate interests of the database maker, are prohibited. According to current national and European legislation, the content of this website is also protected against Industrial Property infringements, owned by the COMPANY, with the reservation of rights of third-party owners. Any violation or deviation from the restrictions of this term regarding the protection of Intellectual Property concerning this website is only permitted after written permission from the COMPANY or the rights holder or through an agreement between the COMPANY or the rights holder and a third party.
4.6 The distinctive features (through their use or establishment in transactions), as well as all the content of the Website, are further protected under the provisions of the law on unfair competition [Law 146/1914, as amended]. The Domain Name “kaktos.gr” has been legally assigned by the National Telecommunications and Posts Commission (EETT) to the COMPANY, which has among other rights the exclusive right to use it. Furthermore, the COMPANY prohibits any third party from registering a domain name identical to the specific conditions and requirements of the Regulation on the Management and Allocation of Domain Names with the .gr extension [Decision 351/76/20.5.2005].
4.7 The COMPANY also prohibits any third party from using exclusively alphanumeric elements similar to those from which the Variable Domain Name with the .gr extension (kaktos.gr) of the COMPANY is composed, without its consent, for the composition of the Variable Domain Field of another .gr Domain Name at the same level, whose Non-Variable field is the same as the Non-Variable field of the COMPANY’s Domain Name, and from using exclusively alphanumeric elements similar to those from which the Variable Domain Name with the .gr extension that has been committed to the COMPANY is composed, without the COMPANY’s consent, for the composition of the Variable Domain Field of another .gr Domain Name at the same level, whose Non-Variable field is the same as the Non-Variable field of the COMPANY’s Domain Name [Article 4 par. 3 Decision 351/76/20.5.2005].
4.8 Similarly, any analog or digital recording and direct or indirect, temporary or permanent mechanical or non-mechanical reproduction, distribution, transfer, downloading, modification, resale of all the works of the previous paragraph by any means or form, in whole or in part, and the creation of permanent or temporary copies (subject to Article 28B of Law 2121/1993), as well as the misleading of the public regarding the actual provider of the content, any reproduction, republication, uploading, announcement, dissemination, or transmission, or any other use of the content of the Website by any means or medium for commercial or other purposes, and in general any kind of action on the commercial, economic, and all types of files of the COMPANY, without the prior written permission of the COMPANY and any other lawful holder of intellectual property rights included on the Website, are prohibited.
5. USER / CLIENT RESPONSIBILITY
5.1 The user/client accepts these Terms of Use and is committed to using the Services, information, and data of the Online Store, in accordance with them and the applicable law, as well as the principles of good faith and transactional ethics.
5.2 The user of the Website agrees not to use the Online Store with the trademark “ΕΚΔΟΣΕΙΣ ΚΑΚΤΟΣ” to send, publish, email, or otherwise transmit any content that is illegal, harmful, threatening, offensive, annoying, defamatory, slanderous, obscene, indecent, libelous, invades someone else’s privacy, shows prejudice, or expresses racial, national, or other discrimination, may cause harm to minors in any way, is not allowed to be transmitted under the law or contractual or managerial relationships (such as internal information, proprietary and confidential information acquired or disclosed as part of employment relationships or covered by confidentiality agreements), violates any patent, trademark, trade secret, copyright, or other proprietary rights of third parties, contains software viruses or any other codes, files, or programs designed to interrupt, cause damage, destroy, or equip computer software or hardware, intentionally or unintentionally violates applicable Greek and European legislation, may harass or offend third parties in any way, and any content used for collecting, monitoring, and storing personal data about other users.
6. USER ACCOUNT (WEB ACCOUNT)
6.1 Through the Website, users are provided with the opportunity to register and create a personal account by entering the necessary information as indicated in the electronic account creation form. Each user is solely responsible for the information they provide, which must be true and accurate. The COMPANY reserves the right to cancel the registration of the specific user at any time if it is found that the real details have not been provided.
6.2 Among the details that each user must declare when creating their personal account are their full name and email address. The email address must be true, complete, personal to each user, and under their full control. In the case of incorrect registration, the COMPANY reserves the right to process the user’s email address to correct it.
6.3 Any natural person who has reached the age of 18 and has full legal capacity may create a personal account. During the creation of the personal account, each user records the password they desire. Access and use of the personal account are possible using the email address and password. These details are personal to each user and should not be disclosed to any third party. Each user is solely responsible for all actions taken using their email address and password, and they must immediately notify the COMPANY of any unauthorized use. In any case, the COMPANY is not liable to the user for any damages arising from this.
6.4 The COMPANY is committed to protecting and securing the personal data of users in accordance with these Terms of Use, the applicable legislation, and the COMPANY’s current Privacy and Personal Data Protection Policy.
7. PURCHASE OF PRODUCTS
7.1 The Online Store offers approximately 1,500 titles of the COMPANY’s books for sale. To facilitate user search, products are divided into two main categories: Ancient Greek Literature and Modern Publications. In case you are looking for something specific, use the “Search” function, which will take you directly to your chosen selection.
7.2 Although the COMPANY makes every effort to provide high-quality services, it is not liable for errors in pricing and product specifications, nor can it ensure that there will be no interruptions in the operation of the Website or no human errors in updating / listing product prices.
7.3 For the safety and effectiveness of your purchases, if you find that a product offered at an unusually low or high price compared to its market value, before placing your order, please contact us at the company’s call center or send us an email at support@kaktos.gr.
7.4 Offers and discount coupons mentioned on the COMPANY’s website or sent with the COMPANY’s informational emails (newsletter) are valid only for online purchases on the website www.kaktos.gr. The COMPANY is not obligated to offer the same discount for sales completed outside the website (by phone, at the bookstore, etc.).
7.5 Telephone orders: In case of difficulty using the Website, it is possible to place a telephone order through the COMPANY’s call center. In this case, it is not possible to place an order with payment by credit card or PayPal account.
8. CANCELATION OF ORDERS
8.1 Cancellation of book orders and physical products in general is possible within 14 days from the moment of creating the online order. To cancel your order within this time frame, you can contact us at the COMPANY’s call center or send us an email at support@kaktos.gr..
8.2 Cancellation of tickets purchased online for attending events at the COMPANY’s bookstore, for any reason, is not allowed either before or after the event.
9. PAYMENT METHODS
9.1 Payment via Debit or Credit Card: The online store of Kaktos Publications accepts all Visa, Mastercard, and American Express credit cards. Your transactions on our website are processed through the secure payment platform of ALPHA BANK. During the payment process, the ALPHA BANK platform will ask you to enter your card details (name, card number, expiration date, PIN, etc.). These details are not disclosed to the COMPANY and are not stored in any COMPANY database. If you choose to pay by credit card, you must be present at the time of order delivery and display your credit card and ID to the courier. In this case (payment by credit card), the order cannot be collected by a third party unless they are authorized by you and are able to present your ID.
9.2 Payment in up to 6 interest-free installments with a credit card: Using a credit card allows payment in up to 6 installments for purchases over 200 euros. The exact number of installments depends on the final amount of the purchase and is displayed in the payment methods at the completion of the purchase.
9.3 Paypal: The online store of Kaktos Publications accepts payment through your PayPal account for your order. Payments with PayPal on our website are made through the secure payment platform of PAYPAL. Your PAYPAL account details are not disclosed to the Company and are not stored in any Company database. It is not allowed to pay for products with SKU 004100 and 004101 with PAYPAL.
9.4 Payment on delivery of the order to your location (cash on delivery): Pay the courier upon delivery of your order to your location. Payments over 499 euros cannot be made on delivery, according to current legislation. The cash on delivery option incurs a cost of 2 euros.
9.5 Payment by bank deposit: Deposit money into one of the following bank accounts (for faster processing, you can email us the proof of payment).
10. DELIVERY OF PRODUCTS / SHIPPING COSTS
10.1 Order completion: Upon completion of the order, an informative email is automatically sent to the email address you provided during your order. This email informs you of your order number, which you should use when contacting the COMPANY regarding anything related to your order.
10.2 Order delivery: The COMPANY makes every effort to deliver orders as follows:
- Up to 20 books are delivered within 8 working days from the receipt of the order.
- Over 20 books are delivered within 15 working days from the receipt of the order.
- Special offers are usually dispatched within 15 working days.
- The complete series of 817 volumes is delivered within 30 calendar days from the completion of the order.
In case of inability to meet the above deadlines, the Company attempts to contact the Customer by phone to inform them or sends an informative email.
10.3 Place of Delivery: Orders are delivered to the address provided by the user/customer as the shipping address during the process of electronic ordering and purchasing of books. Any change of address incurs additional costs to the Customer for any possible increase in transportation expenses.
10.4 Shipping costs within Greece: Books valued up to 20 euros are charged with shipping costs of 3 euros. Books valued over 20 euros are shipped without shipping charges.
10.5 Shipping costs for destinations outside Greece: The shipment of books outside Greece is carried out via the DHL company. The shipping cost is calculated during your order through DHL’s special algorithm. Alternative shipping methods are considered for purchases of over 50 books and when payment is not made via PayPal, if you contact the COMPANY through the call center.

11. PRODUCT RETURNS
11.1 In the event that a package is not received by the customer, there is the option for its re-dispatching, with all expenses (both for return and re-dispatch) charged to the customer.
11.2 In the case of a defective copy, the Customer may request a replacement within 3 months of receipt. Beyond the three-month period, the Company is not obliged to replace the book. A defective copy is defined as a book with missing pages and/or printing problems that prevent the complete reading of the text, or is received with significant defects such as stained or torn pages.
12. INTERPRETATIVE PROVISIONS
12.1 Acceptance of the present Terms of Use constitutes a complete and final agreement between the contracting parties (i.e., the COMPANY and the user/customer) and supersedes any prior written or oral agreements.
12.2 The use of titles in these Terms of Use is indicative and in no case can they be invoked with the purpose of changing the meaning of a provision or restricting its application.
12.3 Any waiver, granting of extension, or non-application of one or more provisions of these Terms of Use by the COMPANY and/or the user/customer cannot be construed as a waiver, temporary or permanent, partial or total, of any right or claim arising from these and the COMPANY and/or the user/customer may at any time demand the full and complete application.
12.4 In the event that any provision of these Terms of Use is deemed void or unenforceable, the remaining provisions shall remain in full force.
12.5 In the event of conflicting interpretations or interpretations of these Terms of Use, the Greek text prevails over any translation into another language.
13. APPLICABLE LAW – JURISDICTION
13.1 In the event of disputes that may arise regarding the interpretation, execution, or application of these Terms of Use or arising therefrom, the COMPANY and the user/customer shall make every effort to resolve them amicably, in accordance with the principles of good faith and fair dealing.
13.2 For any disputes arising from these Terms of Use, the courts of Athens shall have exclusive jurisdiction. Greek law is applicable.
